Welcome! ChronoFlow LLC, the creator of the TIVAL application (the "App" or "TIVAL"), wants you to understand that the following terms and conditions govern Your use of the App. By using the App, you explicitly agree to these Terms and Conditions. If you do not agree, please do not use the App.

Interpretation and Definitions

The following capitalized terms have the following meanings:

• "Account" means a unique account created by a User to access the App.
• "App" means the software program provided by ChronoFlow LLC and downloaded by You on any electronic Device, named TIVAL.
• "Cookies" are small files that are placed on Your Device (e.g., computer, smartphone, tablet, or any other Internet-capable electronic device) for Your Information to be stored and retrieved over the Internet
• "Device" means any device that can access and run the App, such as a computer, a cell phone, or a digital tablet.
• "Information" is any digitally-transmissible data that relates to an identified or identifiable individual or Device.
• "You" and "Your" means or refers to the individual using the App (the "User").

1. Acceptance of Terms

By accessing or using the App, you affirmatively agree to comply with and be bound by these Terms & Conditions. If You disagree with any part of these Terms & Conditions, then You should not access or use the App.

2. User Account Registration

A. User Account Creation:
1. You agree to provide accurate and complete information when creating an Account to use App features that share data.
2. For each User Account, You agree You will not use as a username the name of another person or entity, or any name that is not lawfully available for use, or a name or trademark that is subject to any rights of another person or entity other than You without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene. You further agree that, in the event of a breach of this section 2.A.2., ChronoFlow LLC has the right to prevent the use or creation of such an Account, and if such information is not changed upon notice to the User, to delete such Account.

B. User Account Security: You are responsible for maintaining the security of Your Account credentials.

3. Use of the App

A. Permitted Uses: Use the App for personal productivity, entertainment purposes, creating and sharing tasks (that is, dates and times for appointments, meetings, meet-ups, etc.).

B. Prohibited Uses:

• Knowingly entering false User Account information or impersonating others.
• Engaging in illegal activies or similar misuse of the App and any of its features.
• Actual or attempted unauthorized access to another user's Account.
• Copying or redistributing the App or any of its content without permission.
• Sharing any defamatory, descriminatory, or derogatory information; or violating the privacy of a third person; or continuing to engage in any of these activities after having received notice of such a Prohibited Use.

4. Intellectual Property

All content, features, and functionality of the App is the property of ChronoFlow LLC or is licensed thereby, and are protected by intellectual property laws.

5. Privacy

Your use of the App is also governed by the ChronoFlow LLC Privacy Policy found on this website (via the link above).

6. Limitation of Liability

This App is provided "as is" without warranty of any kind, including as to merchantablity and fitness for any particular purpose, to the extent permitted by applicable law. You agree to hold ChronoFlow LLC harmless from any and all damages arising from Your use of the App, including inaccuracies in features like alarms and timers. In any action alleging damages arising from access or use of the App, the User agrees that the presumed interpretation of these Terms & Conditions is to be through the laws of the Commonwealth of Pennsylvania, and the User further agrees that any Choice of Law issue will be resolved to choose the law more favorable to ChronoFlow LLC.

7. Modifications

These Terms & Conditions may be updated at any time, without notice. Your continued use of the App evidences Your consent to abide by the Terms & Conditions existing and published on www.tival.us at the time You access or use the App.

8. Suspension/Termination

Your access to the App and to Your Account may be suspended or terminated, at the sole discretion of ChronoFlow LLC, if You violate any of these Terms & Conditions.
